Conditions of sale
1. General:
We furnish our achievements and supplies exclusive due to following conditions.
Deviating agreements have validity only if they are recognized in writing by us.
If one of the following conditions for any reason should be ineffective,
remaining contents of the conditions remain however valid.
2. Offers, prices & Rendering of invoice:
Our offers are always not-binding.
All prices in the price list are inclusive of the legal value added tax (19%) from stock Schwelm.
Misprint and mistakes reserve.
At the computation the prices valid at the day of delivery arrive.
Our calculations are purely net in euro (?) plus the legal value added tax.
3. Packing, dispatch & Supply:
The packing is computed at the cost price and is not taken back.
The dispatch of the commodity takes place, if differently does not agree upon in principle
by cash on delivery DHL (post office).
Forwarding expenses, also returns, take place on calculation and danger of the
orderer/buyer. The orderer/buyer has to examine and if necessary from the
transport enterprise confirmed immediately have arriving supply/transmissions
immediately for completeness of the supply and transport damages.
The return of sold commodity is in principle impossible.
If exeptionally commodity is taken back, 80 % are credited by day to the cancelling of valid net price.
If the acceptance of a correct supply of the orderer/buyer is refused,
the back storage is placed to this at height of 30% of the commodity value,
as well as all packing and forwarding expenses in calculation.

Die für das Land entsprechende Mwst. und Zollgebühren werden je nach Lieferant unmittelbar bei der Lieferung fällig.
Wird die Ware als Brief verschickt, müssen wir die Mwst. berechnen. Normalerweise fallen dann auch keine Zollgebühren an.

5. Delivery times:
Delivery times are indicated after best knowing and discretion,
are however in each case noncommittal.
The delivery times begin after receipt of all documents necessary for the
execution of the legal transaction. Requirements for compensation made
of failure to deliver are impossible.
6. Retention of title:
All commodity supplied by uremains up to the complete payment of the purchase price,
as well as up to the payment of all commitments from the business relation to the
orderer/buyer our property. The orderer/buyer is not up to then entitled to convey the
commodity to third for security. A resale to third is only so long permissible
only in the usual course of business and, as the orderer/buyer is not in delay.
In the case of a delay of payment we are entitled to take due to our retention of title the
supplied commodity in possession. In this case the orderer/buyer is obligated to
publish on requirement the supplied commodity immediately.
7. Guarantee & Objections:
Warranty claims, fall under the statute of limitations at the expiration of the legal
period of six months since supply to the orderer/buyer. The guarantee is only limited
to substitution of an unsatisfactorily supplied commodity. If as can be prove incorrect
commodity were supplied, then we reserve ourselves to supply replacement or to give
however a credit note. Objections because of lack of goods must be raised within
eight days in writing, not become later complaints recognition. The article is to be
sent back freely at us. We do not take over adhesion for the assembly and use of
our accessories, products and racing parts. Likewise for damages, which could
result from the assembly of our accessories. The orderer/buyer is obligated on
use of our commodity to examine the suitability first. Requirements for compensation of all kinds,
in particular because of persons -, special or financial damages, same from which argument,
from being to blame for with conclusion of a contract and from bad action, are impossible.
8. Special/one-off production:
For special/one-off production we raise a pre-payment from 20 % of the goods net value.
A requirement on cancelling or subsequent delivery of special/one-off productions does not exist.
9. Other:
Mass, weights, illustrations and designs in our documents are noncommittal.
The area of jurisdiction for orderer/buyers and salesmen is excluding Schwelm.
All arrangements require writing.
The buyer has to take care that all changes and re-equipment
at the vehicles participating in the traffic are registered to the
legal regulations to correspond and in the Kfz papers.
